TERMS OF SERVICE

These Terms of Service apply to every visit to playwlucks.com and to every order placed through it. Please read them carefully before you shop with us.

1. WHO WE ARE

Playwlucks is an online store operated by Ngassa Care B.V., a Belgian private limited company with its registered office at Rumbeeksesteenweg 92, 8800 Roeselare, Belgium, registered in the Belgian Crossroads Bank for Enterprises under company number 1019.151.383. In these terms, "Playwlucks", "we", "us" and "our" refer to Ngassa Care B.V. "You" refers to anyone who visits our website or places an order.

2. ACCEPTANCE OF THESE TERMS

By using our website or placing an order, you agree to these Terms of Service together with our Privacy Policy, Shipping Policy and Returns and Refunds Policy. If you do not agree, please do not use the website or place an order.

By placing an order, you confirm that you are at least 18 years old or that you have the consent of a parent or legal guardian.

3. OUR PRODUCTS

We sell bedding, pillows, blankets and sleep accessories for personal and household use. We do our best to describe and photograph every product accurately. Colours can look slightly different depending on your screen, and small variations in size, texture or finish are normal for textile products.

Our products are designed for comfort and relaxation. They are not medical devices and are not intended to diagnose, treat or prevent any medical condition.

4. PRICES AND PAYMENT

All prices are shown in euros and include the applicable VAT. Shipping costs, if any, are shown separately before you complete your order.

Payment is processed securely through the payment methods offered at checkout. We do not store your full card details. Your order is only accepted once payment has been successfully authorised.

We may change our prices at any time. The price that applies is the one shown at the moment you place your order.

5. HOW A CONTRACT IS FORMED

The products shown on our website are an invitation to make an offer, not a binding offer from us. When you place an order, you make an offer to buy the selected products. You will receive an email confirming that we have received your order. The contract between you and us is formed when we send you a second email confirming that your order has been dispatched, or when we deliver the products, whichever comes first.

We may refuse or cancel an order, for example if a product is out of stock, if there is an obvious pricing error or if we suspect fraudulent activity. If payment has already been taken, we will refund it in full.

6. DELIVERY

We currently deliver to addresses in Germany only. Details about delivery options, costs and times can be found in our Shipping Policy.

7. RIGHT OF WITHDRAWAL AND RETURNS

As a consumer, you have the right to withdraw from your purchase within 14 days of receiving your order without giving a reason. Full details, including exceptions and the withdrawal form, are set out in our Returns and Refunds Policy.

8. WARRANTY

All products are covered by the statutory legal guarantee for consumer goods. If a product is faulty or does not match its description, please contact us at info@playwlucks.com and we will arrange a repair, replacement or refund in line with your legal rights.

9. ACCURACY OF INFORMATION

Occasionally our website may contain typing errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping costs or availability. We reserve the right to correct these errors and to update information at any time, including after an order has been placed. If a correction affects your order, we will contact you before proceeding.

10. USE OF OUR WEBSITE

You agree not to use our website for any unlawful purpose or in a way that could damage, disable or overload it. In particular, you must not upload viruses or harmful code, attempt to gain unauthorised access to our systems, collect personal data of other users, send spam or use automated tools to copy or scrape our content.

11. COMMENTS AND FEEDBACK

If you send us comments, suggestions or ideas, you agree that we may use them to improve our store without any obligation to pay you or to keep them confidential. Please make sure anything you send us is lawful, respectful and does not infringe the rights of others.

12. INTELLECTUAL PROPERTY

All content on our website, including texts, photos, graphics, logos and the Playwlucks name, belongs to Ngassa Care B.V. or its licensors. You may not copy, reproduce or distribute any of this content without our prior written permission.

13. THIRD PARTY LINKS AND SERVICES

Our website may contain links to third party websites or use tools provided by third parties, such as payment providers. We are not responsible for the content or practices of those third parties.

14. LIMITATION OF LIABILITY

We are liable without limitation for damage caused intentionally or through gross negligence, and for injury to life, body or health. In all other cases, our liability is limited to the foreseeable damage typical for this type of contract, as far as the law allows. Nothing in these terms limits your statutory rights as a consumer.

15. GOVERNING LAW

These terms are governed by Belgian law. If you are a consumer living in Germany, you also keep the protection of the mandatory consumer laws of Germany. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. SEVERABILITY

If any part of these terms is found to be invalid or unenforceable, the remaining parts will continue to apply in full.

17. CHANGES TO THESE TERMS

We may update these Terms of Service from time to time. The version published on our website at the time of your order applies to that order.
